Terms & Conditions
Last Updated: September 28, 2026
These Terms & Conditions (“Terms”) govern your use of the RetroForward website and any products, services, digital materials, subscriptions, or other offerings purchased or accessed directly through the website.
By accessing this website, submitting information through the website, or purchasing an offering from RetroForward, you agree to these Terms.
1. About RetroForward
RetroForward provides creative and communications services, including strategy, content, design, digital and web services, production, and ongoing support.
These Terms apply to your use of the RetroForward website and transactions made directly through it.
Client projects may also be governed by a proposal, Statement of Work (“SOW”), Master Services Agreement (“MSA”), service agreement, or other written agreement. If a signed agreement conflicts with these Terms regarding a particular engagement, the signed agreement will control for that engagement.
2. Website Use
You may use this website for lawful purposes and to learn about, inquire about, or purchase RetroForward products and services.
You agree not to:
- Use the website for unlawful, fraudulent, or abusive purposes.
- Attempt to gain unauthorized access to the website, its systems, or accounts.
- Interfere with the operation, security, or availability of the website.
- Introduce malicious software, automated attacks, or other harmful technology.
- Copy, reproduce, distribute, or commercially exploit website content except as permitted by law or with written permission from RetroForward.
- Misrepresent your identity or your authority to act on behalf of another person or organization.
RetroForward may restrict or terminate access to the website when reasonably necessary to protect the website, its users, or RetroForward.
3. Inquiries and Project Discussions
Submitting a contact form, scheduling a consultation, requesting an estimate, or otherwise communicating with RetroForward does not by itself create a client relationship or obligate either party to begin a project.
A client engagement begins when the parties agree to the applicable project terms, which may include execution of an SOW, proposal, agreement, or other written authorization and payment of any required initial project payment.
Project scope, deliverables, responsibilities, schedule, pricing, and payment terms will be defined in the applicable project documentation.
4. Estimates and Proposals
Unless otherwise stated, estimates and proposals are based on the information available when they are prepared.
Changes in scope, assumptions, requirements, deliverables, schedules, client responsibilities, or third-party costs may affect pricing and timing.
RetroForward may require written approval before performing work outside the agreed scope.
5. Payments
Prices and payment schedules will be displayed at checkout or identified in the applicable proposal, SOW, invoice, subscription, or service agreement.
You agree to provide accurate and current billing information and authorize RetroForward and its payment processors to charge the applicable amounts.
For client projects, an initial project payment or deposit may be required before work begins or production capacity is reserved.
Failure to make required payments may result in suspension or delay of services.
6. Deposits and Initial Project Payments
The treatment of deposits and initial project payments is governed by the applicable proposal, SOW, or agreement.
If a project is canceled after work has begun, RetroForward may retain or apply amounts already paid toward work performed, completed milestones, approved expenses, reserved resources where provided for in the applicable agreement, and noncancelable third-party commitments.
Any remaining amount eligible for refund will be handled according to the applicable agreement and RetroForward’s Refund & Returns Policy.
Nothing in these Terms limits refund rights that cannot legally be waived.
7. Recurring Services and Subscriptions
RetroForward may offer recurring services such as managed hosting, website maintenance, technical support, consulting, content support, or other ongoing services.
The price, billing frequency, included services, renewal terms, and cancellation requirements will be identified when the service is purchased or in the applicable agreement.
Unless otherwise stated, cancellation prevents future renewals but does not automatically entitle the customer to a prorated refund for a billing period that has already begun.
Prepaid services and unused future service periods will be handled according to the applicable service agreement and Refund & Returns Policy.
8. Digital Products and Downloads
RetroForward may offer templates, resources, documents, design assets, educational materials, software-related products, or other digital products.
Unless otherwise stated, purchasing a digital product gives you a limited, non-exclusive, non-transferable right to use that product for its intended purpose.
Purchasing a digital product does not transfer ownership of RetroForward’s underlying intellectual property.
You may not resell, redistribute, sublicense, reproduce for resale, or make a digital product publicly available unless the applicable license expressly permits it.
Refunds for digital products are governed by the Refund & Returns Policy and applicable law.
9. Client Materials
When you provide RetroForward with text, photographs, logos, video, data, trademarks, documents, designs, or other materials, you represent that you own those materials or have the necessary rights and permissions for RetroForward to use them for the requested work.
You remain responsible for the accuracy, legality, and appropriateness of materials you provide.
10. Intellectual Property
Unless otherwise stated, the RetroForward website and its original content, designs, graphics, branding, written materials, processes, templates, frameworks, code, and other materials are owned by or licensed to RetroForward and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, sell, license, publish, or commercially exploit RetroForward content without permission except as permitted by law.
Ownership and licensing of work created for a client are governed by the applicable client agreement.
Unless otherwise provided in that agreement, RetroForward retains ownership of its pre-existing materials, methodologies, frameworks, templates, tools, code libraries, processes, and other background materials.
11. Third-Party Products and Services
RetroForward may use, recommend, integrate, resell, or provide access to third-party products and services, including hosting platforms, software, plugins, fonts, stock assets, domain services, analytics platforms, payment processors, and other technology.
Third-party products and services may be governed by their own terms, licenses, privacy policies, pricing, and availability.
RetroForward does not control third-party services and cannot guarantee that they will remain available, unchanged, compatible, or error-free.
Third-party charges that have already been incurred may be non-refundable.
12. Websites and Digital Services
RetroForward may design, develop, maintain, host, or support websites and other digital products.
Technology, browsers, devices, software platforms, plugins, APIs, hosting environments, accessibility standards, search algorithms, security threats, and third-party services evolve over time. Unless specifically included in an ongoing service agreement, delivery of a website or digital product does not include indefinite maintenance, updates, compatibility work, security monitoring, or future modifications.
Specific maintenance and support obligations will be defined in the applicable agreement.
13. Accessibility, Privacy, and Legal Requirements
RetroForward may incorporate generally accepted professional practices when developing websites, communications, and digital materials. However, unless specifically included in the scope of work, RetroForward does not provide legal, regulatory, tax, privacy, or compliance advice.
Clients remain responsible for determining the legal and regulatory requirements applicable to their organizations, industries, websites, communications, and data practices.
Clients should consult qualified professionals when legal or regulatory guidance is required.
14. No Guarantee of Results
RetroForward works to provide professional services and deliverables consistent with the agreed scope.
However, creative, communications, marketing, digital, and strategic work can be affected by circumstances outside RetroForward’s control.
Unless expressly stated in a written agreement, RetroForward does not guarantee specific business outcomes, revenue, fundraising results, sales, audience growth, search engine rankings, media coverage, engagement levels, or other performance results.
15. Website Information
RetroForward makes reasonable efforts to keep information on this website accurate and current. However, website content may occasionally contain errors, omissions, outdated information, or technical issues.
RetroForward may update, modify, correct, or remove website content, services, descriptions, pricing, or availability when appropriate.
16. Links to Other Websites
This website may contain links to third-party websites or services.
Those links are provided for convenience or informational purposes. RetroForward does not control third-party websites and is not responsible for their content, availability, security, privacy practices, or terms.
17. Refunds and Cancellations
Refunds, cancellations, returns, and billing corrections are governed by RetroForward’s Refund & Returns Policy and any applicable proposal, SOW, subscription terms, or service agreement.
If those documents contain different terms for a particular client engagement, the applicable client agreement will control.
18. Disclaimer of Warranties
To the extent permitted by law, the RetroForward website and publicly available website content are provided on an “as available” basis.
RetroForward does not warrant that the website will always be uninterrupted, completely secure, error-free, or compatible with every device, browser, system, or third-party service.
This section does not modify any specific warranties expressly provided in a signed client agreement.
19. Limitation of Liability
To the extent permitted by applicable law, RetroForward will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of this website or website-based products and services.
For professional client engagements, limitations of liability are governed by the applicable client agreement.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
20. Indemnification
To the extent permitted by law, you agree to be responsible for claims, damages, losses, or expenses resulting from your unlawful use of the website, your violation of these Terms, or materials you provide without the necessary rights or permissions.
For professional client engagements, any additional indemnification obligations will be governed by the applicable client agreement.
21. Suspension or Termination
RetroForward may suspend or terminate access to website-based services when reasonably necessary because of nonpayment, misuse, security concerns, violation of these Terms, unlawful activity, or other material breaches.
Termination of a professional client engagement is governed by the applicable agreement.
22. Privacy
Information submitted through this website is handled according to RetroForward’s Privacy Policy.
Certain transactions or services may also involve third-party platforms with their own privacy practices.
23. Changes to These Terms
RetroForward may update these Terms periodically to reflect changes to its services, business practices, technology, or legal requirements.
The current version will be posted on this website with its effective or last-updated date.
Changes to website Terms do not retroactively modify a separately signed client agreement unless the parties agree otherwise.
24. Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.
Any dispute concerning a separately executed client agreement will be governed by the dispute resolution and governing law provisions contained in that agreement.
25. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
26. Entire Website Terms
These Terms, together with the Privacy Policy, Refund & Returns Policy, and any additional terms presented for a particular website purchase or service, constitute the terms governing general use of this website.
Professional client engagements may be subject to additional agreements, including proposals, SOWs, MSAs, and service agreements.
27. Contact
Questions about these Terms & Conditions may be submitted through the contact information or contact form provided on the RetroForward website.
When contacting RetroForward about a transaction, please include your name, organization, invoice or order number if applicable, and a brief description of your question.
